Terms of use

Last updated September 28, 2026

Duly Named (the "site") is owned and operated by The Quiet Buttinsky LLC, a New York limited liability company ("we," "us," or "our"). By using the site, you agree to these terms. If you do not agree to these terms, do not use the site.

IMPORTANT: THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER IN THE "DISPUTE RESOLUTION" SECTION BELOW. THEY AFFECT HOW DISPUTES BETWEEN YOU AND US ARE RESOLVED, INCLUDING YOUR RIGHT TO GO TO COURT AND TO A JURY TRIAL. YOU MAY OPT OUT OF ARBITRATION AS DESCRIBED BELOW.

Age requirement

The site is intended for users 13 years of age and older. By using this site, you represent that you meet this minimum age requirement.

Using the site

The site is free for personal use. Please don't misuse it: no automated scraping, overloading the service, interfering with ads, or trying to get around the site's language filter.

The names we suggest

Names are generated automatically, partly from what you type and partly by AI. They're offered for fun and inspiration, as-is.

Planning guides are not professional advice

Guides in our Plan ahead section, including sponsored guides, explain general concepts only. They aren't legal, tax, financial, or insurance advice, laws differ by state and change over time, and reading them doesn't create an attorney-client or advisory relationship with the author, the sponsor, or us. Talk to a licensed professional about your situation. See our editorial policy for how sponsored guides are labeled and reviewed.

Your inputs

Don't enter sensitive personal information, such as account numbers, government ID numbers, or passwords. See our privacy page for how inputs are handled.

Advertising, affiliate links, and sponsors

The site shows ads and may link to other websites. Some product links are affiliate or sponsored links: we earn a commission from our retail partners if you buy through them, at no extra cost to you. Purchases are made with the retailer, not with us, so their prices, terms, shipping, and returns apply. We're not responsible for the content, products, or practices of advertisers, sponsors, or linked sites.

Name previews are illustrations only. The finished product from any retailer may look different.

No warranty; limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL GENERATED NAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL THE QUIET BUTTINSKY LLC, ITS MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, THE SITE OR ANY OUTPUT GENERATED BY THE SITE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS STRICTLY LIMITED TO $100.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, except that the Federal Arbitration Act governs the "Dispute resolution" section.

Dispute resolution

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND US TO RESOLVE MOST DISPUTES THROUGH INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND IT LIMITS HOW CLAIMS CAN BE BROUGHT.

1. Try to resolve it informally first

Before starting arbitration or a small-claims case, you and we agree to try to resolve any dispute informally. The party with a concern will send a written notice describing the dispute, the relief requested, and how to reach them. Send notices to us at hello@dulynamed.com or by mail to The Quiet Buttinsky LLC, 418 Broadway, Ste N, Albany, NY 12207. We will send notices to you at the email address you provide. If the dispute isn't resolved within 30 days after the notice is received, either party may begin arbitration or, if it qualifies, a small-claims case. Deadlines for bringing a claim are paused during this 30-day period.

2. Agreement to arbitrate

Except as described in section 3, any dispute, claim, or controversy between you and us arising out of or relating to these terms or the site will be resolved by binding arbitration on an individual basis. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect (the "AAA Rules"), which are available at adr.org. The arbitrator will decide any questions about the scope, validity, or enforceability of this agreement to arbitrate. The arbitrator may award the same individual relief a court could award, but only to the individual party seeking relief and only to the extent needed to provide relief warranted by that party's individual claim.

3. Exceptions

Either you or we may (a) bring an individual claim in small-claims court in Oswego County, New York, or in the county where you live, if the claim qualifies and stays in that court; and (b) ask a court to stop the actual or threatened infringement or misuse of intellectual property or unauthorized access to or interference with the site.

4. Location, hearings, and fees

Any in-person hearing will take place in Oswego County, New York, unless the AAA Rules require otherwise or you and we agree to another location. At your request, the arbitration may instead be conducted by video, by telephone, or based only on written submissions. Payment of filing, administration, and arbitrator fees will be governed by the AAA Rules, and we will pay all fees the AAA Rules assign to the business.

5. Individual claims only; no class actions

YOU AND THE QUIET BUTTINSKY LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.

6. Jury trial waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL FOR ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE, INCLUDING ANY CLAIM HEARD IN COURT.

7. Your right to opt out

You may opt out of this agreement to arbitrate by emailing hello@dulynamed.com within 30 days after you first use the site, with the subject line "Arbitration opt-out" and your name. Opting out won't affect any other part of these terms, and it won't affect any arbitration agreement you may have with us for other matters.

8. If the class waiver is not enforced

If a court decides that section 5 can't be enforced as to a particular claim or request for relief, then that claim or request (and only that one) will be severed and decided by a court as described in section 9, after any individual claims have been arbitrated. The rest of this section will still apply. In no event will a dispute proceed as a class or representative arbitration.

9. Courts for claims not arbitrated

Any claim that is not subject to arbitration, including a claim you've opted out of, will be heard exclusively in the state courts located in Oswego County, New York, or in the United States District Court for the Northern District of New York, and you and we agree to their personal jurisdiction. Either party may ask such a court to confirm, modify, or enforce an arbitration award.

10. Changes to this section

If we change this "Dispute resolution" section, the change won't apply to any dispute that arose, or that either party gave notice of, before the change took effect. You may reject a future change to this section by emailing us within 30 days after it takes effect; if you do, the most recent version you accepted will continue to apply.

Severability

If any part of these terms is found unenforceable by an arbitrator or court of competent jurisdiction, the remaining portions of these terms will remain in full force and effect, except as provided in section 8 of the "Dispute resolution" section.

Survival and entire agreement

The sections on names, warranties and liability, governing law, dispute resolution, and severability survive after you stop using the site. These terms, together with the privacy page they refer to, are the entire agreement between you and us about the site.

Changes

We may update these terms from time to time and will post the new version with a new "Last updated" date. Changes apply only going forward, and changes to the "Dispute resolution" section are subject to section 10 of that section. Continuing to use the site after a change takes effect means you accept the current version.
